shooting. it led to confusion for cal train riders heading out of san jose tonight. it happened just after 5:00 today near the deradon cal train station. george kiriyama joins us with more. >> reporter: passengers riding cal train tonight experienced up to a 45-minute delay because of this involve-involved shooting here on these tracks. buses were brought in to help shuttle these riders. take a look at this view from our chopper. it shows the aftermath. about 400 yards north of the train station, san jose police tell us a man managed to get on the track. investigators say he would not cooperate with deputies so the officers who chased him after this short foot chase, police say the man came at them with a metal spike. the deputy thought he was in danger and fired several rounds. the man was hit twice. >> at a certain point, if an officer believes his life or his health and safety is in danger or that of his fellow officers and the suspect is actively arming himself, the officer obviously felt threatened and did wh he had to do to protect himself. >> this man was taken to valley

the cal campus this morning. this comes after a group of students filed a complaint accusing the school of being anti-semitic. the complaint says the university allowed an anti-israel protest on campus back in february and claims the school has a hostile campus for jewish students. uc berkeley denying the allegations but say stopping the protest would have infringed on free speech rights. >>> the oakland man who was denied an organ transplant because he's undocumented immigrant has a new kidney this morning. jesus navarro had been waiting for a transplant seven years. last week he was called in for the surgery. navarro had been sidelined for years because as an undocumented immigrant hospital officials were concerned he wouldn't have guaranteed postoperative care. an oakland clinic has volunteered to do that for free. navarro is recovering at home. >>> right now decision 2012 and the expectations the latest jobs reports will of course impact that campaign trail. we've been reporting unemployment could actually rise. as brian mooar reports, that would be some bad news for presiden
